Parallel Avocats successfully represented and defended Brigad in the context of a litigation initiated by a Temporary employment agency aiming at obtaining a ban on its activity as an online platform.
Brigad was sued by a temporary employment agency (intérim) which requested judges to ban its activity consisting in connecting independent contractors with clients in the hotel and restaurant sector.
One of the key elements of the case was to present Brigad’s innovative and technological activity so that judges could understand the differences (both from an operational and legal standpoint) with a temporary employemnt agency.
Thanks to this legal defence, Brigad won this litigation matter in first instance (Créteil Commercial Court), then in appeal (Paris Court of Appeal) and before the supreme court (Cour de Cassation). The opponent failed in its demands and this success allowed Brigad to continue its growth, while obtaining legal recognition for its platform model.
« Parallel Avocats have allowed us to win every step of this procedure and to unload ourselves of a significant part of the mental burden related to the procedure. Their thorough knowledge of Brigad’s business model and the legal issues regarding independent contractors and online platforms have been key assets. »
